Terms of Use

These Terms of Use are an agreement between you and FAZAY SERVICOS DE TECNOLOGIA LTDA ("Fazay Games", "we"), Brazilian company registration (CNPJ) 68.731.006/0001-72. They govern your use of the game OVERSPRAY, its online servers and services, and the website playoverspray.com.

1. Acceptance

By installing, launching or playing OVERSPRAY, you agree to these Terms and to the Privacy Policy. If you don't agree, don't use the game.

The terms of the store where you own the game also apply:

the Steam Subscriber Agreement;
the Epic Games Store Terms of Service and EULA;
Microsoft and Xbox terms, once the game is available there.

For purchases and refunds made through a store, that store's rules apply.

2. Who can play

Minimum age: 13, in addition to the minimum age set by your store.
Age ratings: 14 in Brazil, Teen (ESRB), PEGI 12.
Under 18: you need permission from a parent or guardian, who is responsible for your use of the game and your purchases.

3. License

The game is not sold to you: we grant you a personal, limited, non-exclusive, non-transferable and revocable license to use OVERSPRAY for non-commercial purposes under these Terms.

You may not:

copy, sell, rent, sublicense or distribute the game or any part of it;
decompile, disassemble or reverse engineer the game, except where the law expressly allows it;
modify the game's files, memory or network traffic;
create or use unauthorized servers, tools or clients;
bypass technical protections, including anti-cheat.

Videos and streams: recording matches, streaming, making videos and taking screenshots is allowed and welcome, including monetizing them on video platforms, as long as the content doesn't suggest it is official or sponsored by us.

4. Early Access

OVERSPRAY is in Early Access and still in development. This means:

the game may have bugs, crashes and instability;
rules, markers, economy, maps, modes and interface may change;
the ranking resets every 60-day season and may also be reset to fix problems;
we don't promise dates for future features.

The Founder's Pack includes the content described in the store at the time of purchase and stays valid after the free launch.

5. Your account

How you sign in: with your store account (Steam, Epic or Xbox).
Responsibility: you are responsible for activity on your account and for keeping it secure.
Personal use: you may not sell, lend or share accounts, or use more than one account to manipulate the ranking or avoid a penalty.

6. Virtual items and purchases

What you buy

The Founder's Pack, Premium, skins and season passes are licenses to use content inside the game.

Value: they have no cash value.
Resale: they cannot be exchanged for money outside official channels. One example of an official channel is the Steam Community Market, once enabled and under Steam's rules.
Skins: they only change how things look. Nothing sold gives an advantage in a match, and there are no paid loot boxes.
Season passes: a pass is valid for the season stated at the time of purchase.
Prices and content: may change for future purchases.

Refunds

Refunds follow the policy of the store where you bought the item (Steam or Epic). This doesn't take away any consumer rights you have under the law, including withdrawal rights where they apply.

Bans and items

Items on accounts banned for cheating or fraud may be lost without a refund, to the extent the law allows.

7. Code of conduct

We want fair matches and a decent community. You may not:

Cheat:
aimbots;
wallhacks;
macros;
third-party programs that give an advantage;
modified game files.
Exploit bugs on purpose instead of reporting them.
Manipulate matches or the ranking:
fixing results;
boosting someone else's account;
losing or leaving on purpose;
using alternate accounts.
Sabotage your own team on purpose: for example, with intentional friendly fire or by blocking teammates.
Harass, threaten or use hate speech, or discriminate based on origin, race, color, ethnicity, religion, gender, sexual orientation, disability or age.
Share sexual, violent or illegal content in chat, voice or your name.
Use offensive names.
Spam, scam, sell accounts or promote cheats or unauthorized services.
Impersonate Fazay Games staff or anyone else.
Share other people's personal data.
Attack or overload the game's servers or services.

8. Anti-cheat

OVERSPRAY uses Easy Anti-Cheat by Epic Games. By playing, you agree to the checks described in the Privacy Policy. Disabling, bypassing or interfering with anti-cheat is a violation of these Terms.

9. Reports and penalties

You can report players during a match. We review reports and may take action in proportion to how serious the case is:

a warning;
a text or voice chat mute;
a temporary suspension;
removal from the season or the ranking;
a permanent ban.

Cheating and serious cases may lead to an immediate ban.

Appeals: you can appeal a penalty by emailing dev@fazay.com.br within 30 days and telling us your account. We will reply within a reasonable time.

10. What players send

You are responsible for what you write in chat, what you say on voice and the name you use. You authorize us to deliver this content to other players and to moderate it when needed. We don't record your voice.

11. Intellectual property

The OVERSPRAY name, logo, the "O" symbol, characters, maps, art, sounds, music, text and code belong to Fazay Games or are used by it under license.

If you send us suggestions or ideas, we may use them freely, with no obligation to pay you or credit you.

12. Online service

OVERSPRAY depends on servers and third-party services. Maintenance, outages and region changes may happen without notice.

We may shut down the game's online service. If we do, we will give at least 60 days' notice on the website and in the game.

13. Warranties and liability

The game is provided "as is", especially during Early Access. To the maximum extent permitted by law, we are not liable for:

indirect damages;
lost profits;
data loss;
failures caused by third parties, your connection or your equipment.

Nothing in these Terms limits rights that the law does not allow to be limited, such as those under the Brazilian Consumer Defense Code and EU and UK consumer law.

14. Suspension and termination

On your side: you can stop playing at any time and ask us to delete your data, as explained in the Privacy Policy.
On our side: we may suspend or end your access if you violate these Terms.

15. Changes to these Terms

We may update these Terms. The last update date is at the top of the page. We will announce relevant changes reasonably in advance on the website and, where it makes sense, in the game. If you keep playing after a change, you accept the new version.

16. Governing law and jurisdiction

These Terms are governed by the laws of Brazil.
